68. Enforceable Islamic laws compatible with human endurance. 

These verses of the Quran 2:185, 2:220, 2:233, 2:286, 4:28, 5:6, 6:152, 7:42, 23:62, 65:7 convey that Quranic laws are laid down taking into consideration the endurance of humans.

These phrases provide a solution to many issues. 

In some cases, depending upon the period we live, country, region, health, sickness, senility we may not be able to enforce Islamic laws. These conditions act as a solution for these people. Allah will not hold responsible for not having implemented laws that are not enforceable in the said circumstances. 

For example, Islamic political laws cannot be implemented in India, because it is not under Islamic rule. And non-implementation of Islamic laws in India cannot be construed as a violation of Islam. If keenly observed these phrases can be found to render solutions to many problems.

67. Prophet Muhammad was bestowed scripture with knowledge. (Explanations of the verses of the Quran.)

In these verses of the Quran (2:129, 2:151, 2:231, 3:164, 4:113, 33:34, 62:2) Allah says Prophet Muhammad was bestowed not only the Quran but also knowledge about it alongside.

These verses say this with proper reason. 

Verses 3:48, 3:81, 4:54, 5:110 say, Prophet Muhammad and all other messengers were revealed scriptures along with knowledge about them. 

Prophet Muhammad was not only revealed the Quran, but was also given the knowledge to explain it, is what we understand by these verses. 

The messengers of God were sent along with knowledge about ways to explain the scriptures. The explanations given by them for the scriptures were not of their own making is the message conveyed here through these messages.

The explanations given by the messengers were from God is proved in these verses of the Quran. Hence these verses emphasize the need to place the authenticated sayings of Prophet Muhammad equal to the messages of the Quran, is also a proof seen in these verses. 

Some people who deny hadiths entirely, misquote the phrase ‘scriptures and knowledge’ as knowledgeable scriptures.

Any sensible person would not denote the word ‘knowledgeable scripture’ to mean knowledge and scripture but would express the term as scripture with full of knowledge, or scripture with knowledge. They do not understand it means knowledge and scripture as two words. 

Additionally, some words in these verses expose the ignorance of these people.

Allah says in the Quran verse 4:113, ‘we sent down the Quran, and the knowledge’ thus it could be understood to mean knowledge to explain the Quran was also sent down (revealed) by God.

66. Is the Islamic law on divorce justified?

The verses of the Quran 2:227, 2:228, 2:229, 2:230, 2:231, 2:232, 2:236, 2:241, 4:20, 4:34, 65:1, 33:49 speak about the rights of husbands to divorce their wives. And we find the norms and procedures in these verses to be followed regarding the same it these verses. 

Some consider the rights given to men to divorce the wives are a great injustice to women.

When an option to divorce, a wife is denied to a man when he dislikes her more harm is done to the wife, can be seen from the following evils in the society. 

1. When a man arrives at a juncture where he cannot obtain a divorce or he feels it can be obtained only after a prolonged effort, then he comes to a decision to set up concubines. He will torture the wife and will not provide for her. 

2. Or, to obtain a divorce easily he will accuse her of immorality. 

3. He may set her on fire and call it a suicide or accident. 

We see these kinds of consequences in non-Muslim societies where stringent norms are in place to obtain divorce.

Hence taking into consideration the safeguarding of life, possessions, honor, respect for women, Islam has made easy the grant of divorce.

Though Islam has made granting of divorce an easy affair it does not in any way allow anyone to follow it in a haphazard way. Islam has detailed its guidance in the following manner: 

At first the wife is to be educated in the best way possible to dissuade her from divorce. 

When it does not bear fruit, she must be temporarily kept away from his bed. 

Even if that does not bring any change for good in her, corporal punishment is advised in verse (4:34) of the Quran. 

Hitting on the face of the wife or inflicting injuries on her is vehemently opposed by Prophet Muhammad. 

To prevent people from moving towards divorce a slight corporal punishment is permitted in Islam. 

More than the people who have accepted Islam and its law on corporal punishment, the non- Muslims who are against beating are the ones who beat up their women folk more.

Man is created stronger than woman, at times when they are left alone, we cannot post a security guard to provide protection for the weaker sex, at such a situation an aggravated strong person will naturally have tendency to assault a weak one. This cannot be prevented by any law. 

By declaring to beat women lightly, the possibility of them getting severely beaten can be prevented. This is one of the reasons we find Muslims torturing women to a lesser extent.

Despite all these measures a solution is not reached, then a compromise needs to be negotiated by the members of both families says verse (4:35) of the Quran.

Despite these four activities if a solution could not be arrived at, there is absolutely no meaning in the couple living together and best is to opt for a divorce as allowed by Islam.

A divorce comes into effect when a husband tells the wife ‘I divorce you’ with two witnesses.

A wife is entitled to security money from the husband once the divorce takes effect, and the responsibility of deciding this and getting the amount from the husband lies with the local jamaat.

There are no other rituals whatsoever. 

Three chances are given to a husband to call for a divorce. 

At the first instance of having divorced his wife the marriage bond is not broken completely between them. He can still join the wife within three menstrual periods. And if the wife is carrying an offspring, he can rejoin before the baby is delivered verse (65:4) of the Quran. 

If the couple does not rejoin within the stipulated time their wedlock is broken, nevertheless if they desire to live together, they can enter a wedlock by a marriage, and this is not forbidden. 

In case the couple reunites after the first divorce (Talaq) pronounced, and still not able to tolerate each other, they need follow the norms and procedures cited previously and opt for divorce again. 

As mentioned, previously they can reunite again within the specified period and once the deadline is passed, they can marry again. 

Thus, if the third chance of living together does not bring any change in their relationship they can still opt for divorce. This is the final chance. 

Once the last and final divorce is pronounced, the option for the couple to reunite is closed for ever.

Nevertheless, the divorced wife can opt for a marriage to a different person and, if she happens to obtain a divorce from him (the other person) her former husband can still marry her again. 

This kind of divorce with an option to reunite with the same woman is permitted only twice can be seen from the verse (2:229) of the Quran. 

Muslims who are ignorant of these laws Islam has provided them, destroy their married life, pronouncing ‘talaq’ three times at a stretch or calling just ‘Muttalaq’ once for a divorce to materialize, thinking all other avenues are shut to live together. 

This is entirely wrong, saying the word ‘talaq’ three times or three hundred times means only one option for divorce has been exhausted. This allows space for a reconciliation between the couple as already mentioned, the conditions to reunite within the stipulated time frame that allows the couple to marry again.

However, Ibn Abbas (RA) narrates that at a certain period of the time of Prophet Muhammad pronouncing three times ‘talaq’ was considered a single talaq. 

Hadith Book Muslim: 2932, 2933, 2934. 

The mis concept of considering three ‘talaq’ pronouncement as the final was given shape after Prophet Muhammad’s time.

The divorced women should not be left in the lurch after divorce, the concerned jamaat needs to take the responsibility of getting the financial relief for her from the husband.

Please refer explanation point 74. 

These laws are regarding men seeking divorce, similarly there are laws governing divorce demanded by women. 

During the time of Prophet Muhammad, Saabit bin Quais’s (RA) wife approached him and said, “Oh, messenger of Allah I do not find fault with the good behaviour or conduct of my husband, but I hate him for being Un Islamic.” Though he is a good person, she does not wish to continue living with him. Immediately Prophet Muhammad asked her whether she is ready to return the garden she accepted as Mahar from him. She readily agreed to it. Then the prophet sent word for him told him “Take back the garden and release her from (wedlock) completely”.

Hadith Book Bukhari: 5273, 5275, 5277. 

From the above message the practice of divorce procedures to be carried out by the prophet can be understood.

When a woman dislikes her husband, she needs to convey it to the community leader, who orders her to return the Mahar she accepted from him during the marriage and annul the marriage contract between them, is the message conveyed here.

It is better for women not to break the marriage on their own, because Mahar was accepted by the women with witnesses, and it is appropriate that it is returned with one (community leader) is the reason for this requirement of (community leader) as a witness while returning. 

Since women are subjected to more hardships by divorce, and to discourage them from taking hasty decisions this arrangement is imperative. This paves a way for counselling by the community leader and is better for women to be separated in this way.

Women cannot find a better way to divorce in the whole world than this. A right that could not be won even in the twentieth century Islam had given women fourteen hundred years ago.

A very serious reason is not a must for seeking divorce from the husband, In the above cited incidence the woman did not find any fault with the husband but says she dislikes him, and the prophet also did not question her reason, had questioning the motive been emphasized in the law the prophet would have done so. He granted divorce without interrogation. 

Islam does not consider marriage as something that could not be separated rather views it as a contract to live together.

The verse (4:21) says “Those women having taken a strong covenant from you, and each having entered the other”

 “The same way a husband has rights over the wife so does the wife over the husband” says verse (2:228) of the Quran.

Like evil consequences that might take place if the avenue for divorce is denied or delayed for men the same could occur in the case of women. 

It has come to such a situation that wives who dislike their husbands are pushed to a corner of eliminating them. 

They poison their husband to death or collude with their illegal lovers to murder them. When given an opportunity to obtain divorce from their husbands in an easy way, and allowed to remarry as wished, such kind of incidents can be avoided.

Hence the right to divorce is granted to women also in Islam This right to women to opt for divorce when required is granted to them in a measure equal to that of men. This can be seen in the verses (2:228-232) of the Quran.

65. Sunday. Swearing against one’s wife.

There was a practice among the Arabs those days, swearing upon God against their wives, not to entertain them forever, because they annoyed them. This verse (2:226) of the Quran not only reprimands them for the practice but also spells out the remedy for this act. 

People who made such vows need not separate themselves from their wives, but can rejoin them by breaking their promise within four months. 

This remedy of four months also applies to persons promised to stay away from wives all their life. 

The condition that they can rejoin within four months does not mean only after four months but even before the completion.

One can break the promise made even immediately the next day. But even after four months he is not ready to join his wife, the alternative is to divorce her says the next verse. 

So, we come to understand that staying away from a wife on a promise made, is a grave matter in the eyes of God. 

Some who stay away from their wives in foreign countries in pursuit of wealth, or within the country for more than four months do not come under the purview of this requirement. Though they are separated bodily they have mutually agreed to do so. The husband is fulfilling the financial needs of the wife; hence no one can accuse them of having not come together within the period of four months.

There are chances that due to health reasons the couple is unable to come together, circumstances, inability, etc., may be the reasons, but not out of dislike for the wife. The people under these kinds of circumstances do not come under the ambit of this verse.

Some out of hatred for the wife neither live with nor divorce her, continuing the torture without providing her the required livelihood. In case such persons continue to separate themselves from their wives even after the period of four months, the concerned jamaat should take active participation in requesting such men to renew their relationship and provide livelihood to them. (wives).

And if such men continue to exhibit their stubbornness in not complying to such laws, the Jamaat carries the duty of announcing their divorce. 

Though there is an opportunity of asking a question, how can one act against the promise made in the name of God, the answer is, the same God has given an opportunity to rejoin. This goes to prove how cruel it is for a person to stick on to stubbornness without any commitment to a promise made and relaxations offered as remedies. 

64.Saturday.Promises that are required to be adhered to.

In these verses (2:224, 2:225, 3:77, 5:89, 16:91, 16:94, 58:16, 63:2) of the Quran, laws regarding upkeep of promises are being spoken of.

If a person undertakes to commit an act in the name of Allah, he should either fulfill it or find a remedy as said in verse 5:89.of the Quran. If neither is done he is liable for punishment.

Some people instantly without any thought say “I promise in the name of Allah”. Making a promise without any intention is not punishable says verse 2:225 of the Quran.

But making promises in the name of Allah to deceive others, or to safeguard oneself is punishable say the verses 2:224, 3:77, 16:91, 16:92, 16:94, 58:16, 63:2 of the Quran.

People who want to deceive others by not repaying their dues and others who avoid facing some difficulties, should refrain from making promises in the name of Allah and seek reforms in their behavior on coming across these verses.

Using Allah as a witness to lies and not fulfilling promises made in his name are grave crimes.

63. Wives are fruitful fields.

The Jews during the period of Prophet Muhammad considered some ways of sexual behavior as taboo and believed that a kind of sexual behavior would end in a baby being born with a squint eye.

They (Jews) nurtured a superstitious belief that if a man approaches his wife while having sexual intercourse like a dog does, the resultant baby would be a squint eyed one. To discourage this the verse (2:223) of the Quran “Your wives are your fruit fields, approach them as you wish” was revealed.

Hadith by Muslim:2826. 

This verse was revealed against the superstition nurtured by these people and conveyed that approaching wives during sexual intercourse as men pleased is allowed.

In addition, this verse is against the belief that sexual intercourse should take place only on certain days. This can be understood from the phrase ‘as you desire’. 

This apart, this verse also serves as an eye opener for modern day issues regarding childlessness.

Presently where people who are unable to bear a child undergo artificial fertilization, this verse serves as a solution to the types of artificial fertilization that are allowed and those forbidden.

By the phrase “your wives are your fruit fields’ it could be understood that a husband’s sperm could be used to artificially fertilize a wife and not that of another man. 

There are many aspects of family life that are inset within this phrase.

62. The ways to spend money.

We can find the answer to the question: what kind of money should be spent? in this verse (2:215) of the Quran.

As a response to the question about spending money, the Quran clarifies in verse (2:215) “the wealth that is to be spent should be from a source well earned in the right way”, and also says on whom it should be spent. 

This verse emphasizes the need to spend more on parents, relatives, orphans, the needy and the nomads, 

People who spend on philanthropic needs leave their parents in lurch, and do not bother about their relatives. These are the people who need to be taken care of as a priority is stressed here. 

60. What does the phrase ‘departing in two days’ mean?

This verse (2:203) says ‘Remember Allah in particular days’ 

We should be in Allah’s remembrance always, but this verse seems to suggest that except on the days we need not think about God. 

In this verse there is no mention generally of Allah’s remembrance, but it talks of a type of worship that must be carried out on days. 

Though it is not mentioned in the Quran about the worship, Prophet Muhammad has explained as to what it is. 

I reached Arafat when Prophet Muhammad was there, a group of people from Najd area approached Prophet Muhammad through one of their members asking about Haj. To it Prophet Muhammad said, ‘Haj is all about Arafat’ ‘Whoever reaches Arafat before Fajar salah has attained the Haj the days of Mina are three days, whoever leaves Mina in two days is not a transgressor, and whoever delays also is not one’. And he also deputed one person to announce this message to the people.

Hadith Book Nasaye:2994. 

We need to understand this verse refers to ritual of stoning at Mina as a worship based on this hadith. 

The ritual of stoning is done on three subsequent days, and if any one out of some unexpected reason happens to wind up in two days, it is not counted as a violation on his part.

Though we do not find what ‘departing in two days’ means in the Quran, the explanation given by Prophet Muhammad is clear enough to point its meaning in the above hadith. The explanation given by Prophet Muhammad is as good as the words of the Quran.
